The Insolvency Service reported that Desmond Pheby continued managing Wok & Go Franchise UK Limited while disqualified and used a false employment document in related civil proceedings. He received a 12-month suspended prison sentence, 200 hours of unpaid work and a further 10-year director disqualification. Sharon Pheby also received a community order and a five-year disqualification after admitting aiding and abetting the breach.

Why it matters

A title on an employment document does not necessarily determine whether an individual was acting in company management. Contemporaneous bank records, decision-making and actual responsibilities matter. This is a criminal enforcement outcome, not a routine director loan account disagreement.
