What was published
The Upper Tribunal found errors in the First-tier Tribunal’s approach to education otherwise than at school, the circumstances in which a location may appear in Section F, and the identification of a special school in Section I. The decision was set aside and remitted.
What this means for other cases
Section F provision and Section I placement require distinct, evidence-led reasoning. A location should only be specified as part of Section F where it is inherent or integral to the educational quality of the provision.
What to preserve if you face a similar issue
Keep the original notice or decision, proof of receipt, current deadlines, relevant licences, correspondence and contemporaneous source records. The exact evidence needed depends on the allegation and regulatory procedure. Do not assume another case has the same facts or outcome.
