Traffic Commissioner public inquiry: prepare against the actual allegations
A call-up letter is not simply an invitation to explain what went wrong. It identifies regulatory concerns that may put an operator licence, a transport manager's repute or an undertaking at risk. Start by preserving the full letter, directions, hearing date and all documents served with it. The response should follow the issues identified by the Traffic Commissioner rather than presenting a general account of the business.
Build an issue-by-issue compliance evidence matrix
For each allegation, record the source document, the relevant period, the explanation, the contemporaneous records and the corrective measure now in operation. Maintenance concerns may require inspection schedules, defect reporting, repair records, PMI evidence and evidence of management oversight. Drivers' hours concerns may require tachograph analysis, infringement reports, driver debriefs and documented escalation. Financial standing, operating centre, authorised vehicle and transport manager concerns require different evidence.
Show whether remediation actually works
An action plan alone is weak evidence. Identify who owns each control, when it was introduced, the records demonstrating implementation and how failures are escalated. Distinguish an internal review from an independent compliance audit: they are not interchangeable, and any audit requirement should be checked against the Commissioner's directions.
