For driver-licence decisions outside London, an appeal to the Magistrates’ Court is commonly subject to a 21-day statutory window. The decision notice should state the applicable appeal route and deadline. An immediate suspension or revocation on public-safety grounds can take effect at once despite an appeal, whereas other suspensions or revocations generally take effect after the notice period. The exact position depends on the statutory power used and the notice served.

Revoked, suspended or refused: the decision notice comes first

The licensing authority's decision notice determines what must be challenged. Record the licence type, date of service, statutory power, effective date, reasons and appeal information. Do not assume the rules for a driver licence, operator licence and a Transport for London licence are identical. A complaint or request for reconsideration should not be assumed to preserve a statutory appeal deadline.

Fit and proper person: test each allegation against the evidence

A suitability decision may involve convictions, police information, allegations, complaints, previous licensing conduct or disclosure failures. A useful case file distinguishes proven facts, disputed accounts, incomplete information and mitigation. Compare each issue with the authority's published policy and identify whether the reasons explain how the decision-maker applied that policy. Evidence of rehabilitation, training and present-day controls should be documented, not merely asserted.

Prepare the committee or appeal file

Use an indexed chronology, a schedule of allegations and responses, the relevant policy extracts and the strongest supporting records. Identify gaps in disclosure and inconsistencies between officer summaries and original records. State the precise outcome sought.
