EHCP Refusal to Issue: Appeal Evidence Preparation
How to organise assessment material and professional evidence after a local authority assesses but refuses to issue an EHC plan.

A refusal to issue an EHC plan comes after assessment, so the evidence file should focus on what the assessment established, what support is required and why the local authority says a plan is not necessary.
1. Collect the full assessment record
Keep the refusal decision, all advice obtained during the EHC needs assessment, school evidence, professional reports and any draft summaries or panel material supplied.
2. Map identified needs to required provision
Create a simple schedule of each significant special educational need, the provision recommended to meet it and the evidence showing whether that provision can realistically be secured without an EHC plan.
3. Test the refusal rationale
Identify whether the decision addresses the professional recommendations and current level of support. Flag gaps where the rationale does not engage with material evidence or relies on assumptions not supported by the records.
4. Prepare the appeal structure
State the issue, the evidence from the assessment, the provision required and the outcome sought. Where professionals differ, identify the point of disagreement and the evidence supporting each position.
Tribunal procedure and representation rules must be checked for the particular proceeding and stage.
