Challenge an EHCP: Sections B, F & I Evidence Preparation
A practical evidence-led approach to disputed needs, special educational provision and placement wording in an EHC plan.
Updated October 2026
A challenge to EHCP content should proceed section by section. Needs, provision and placement are connected: weak or incomplete Section B wording can undermine Section F, and both inform the placement evidence in Section I.
1. Audit Section B first
Compare every significant need identified in professional reports with the final plan. Record needs that are missing, diluted, framed only as behaviour or described too vaguely to drive provision.
2. Test Section F against the evidence
Place each professional recommendation beside the provision written into Section F. Identify omissions, non-specific wording, reductions in frequency or expertise, and provisions that are not linked to an identified need.
3. Connect Section I to needs and provision
Where placement is disputed, identify the type of environment, staffing, peer group, therapeutic input, curriculum and specialist expertise required by the evidence. Avoid treating the school name as an isolated preference.
4. Prepare exact amendments
Create a schedule showing the current wording, proposed wording, supporting report and page reference. This turns a general challenge into a concrete set of requested changes.
Tribunal procedure and representation rules must be checked for the particular proceeding and stage.
Questions to ask before proceeding
What is the exact decision? What deadline applies? Which facts are genuinely disputed? What documents prove the important facts? What framework governs the decision? What outcome are you asking for? What has already been tried?

Frequently asked questions
How long should the EHC needs assessment and plan process take?
GOV.UK states that, subject to applicable exceptions, the final EHC plan should be issued within 20 weeks of the local authority receiving the request for assessment.
What EHC plan decisions can be appealed?
Appealable decisions include refusal to assess, refusal to issue a plan, and disputes about specified educational sections of an EHC plan. In most cases mediation advice must be considered before appeal.
