Challenging Temporary Accommodation Suitability
Evidence and decision analysis for disputes about whether temporary accommodation is suitable.
Updated 3 October 2026
A temporary accommodation suitability challenge should connect the household's actual needs to the specific features of the accommodation and the evidence available to the council. Location, medical needs, accessibility, schooling, support networks, affordability and safety may all be relevant depending on the case.
1. Keep the offer and suitability decision
Preserve the accommodation offer, licence or tenancy terms, suitability decision, review information and the date the placement was made or offered. Record every review or challenge deadline immediately.
2. Map household needs to the accommodation
List the household's relevant medical, disability, mobility, care, education, safeguarding, employment and support needs, then identify the specific feature of the accommodation said to be unsuitable for each need.
3. Use objective evidence
Support important points with medical letters, care plans, school information, travel evidence, property photographs, accessibility measurements, risk information and cost evidence where relevant.
4. Address location and affordability separately
Travel distance, disruption to care or schooling and affordability are different issues. Explain each with its own evidence rather than treating 'too far away' or 'too expensive' as a complete suitability case.
5. Prepare a focused review file
Create a short chronology, needs-to-evidence schedule, property issue list and the outcome sought. Keep later changes in circumstances dated so it is clear what the council knew when each decision was made.
Housing challenges can have short review or court deadlines. Preparation support should not be treated as extending or protecting a statutory time limit.
Questions to ask before proceeding
What is the exact decision? What deadline applies? Which facts are genuinely disputed? What documents prove the important facts? What framework governs the decision? What outcome are you asking for? What has already been tried?
