Traffic Commissioner public inquiry: evidence checklist
Preparing for a PSV or HGV operator public inquiry starts with identifying precisely what the call-up letter alleges, the applicable deadlines and the evidence needed to answer each issue. This checklist is a starting point, not a substitute for the directions in your own notice.
Notice and deadlines
- Public inquiry call-up letter, case reference and all enclosures
- Licence number, operator name, hearing date, directions and response deadlines
- Correspondence with the Traffic Commissioner, DVSA and OTC
Operator and management
- Current operator licence and undertakings
- Transport manager appointment, qualifications and oversight records
- Organisational responsibilities, audit trails and compliance reporting
Vehicles and maintenance
- Vehicle list and operating centre details
- Inspection schedules, PMI reports, defect reports and rectification records
- MOT history, safety recalls and maintenance-provider contracts
Drivers and operations
- Driver licence and entitlement checks
- Tachograph, drivers hours and working-time analysis
- Training, disciplinary and corrective-action records
Evidence and remediation
- Chronology of alleged events, with source documents
- Independent compliance audit and findings, where commissioned
- Dated corrective-action plan with responsible owners and proof of completion
How to organise the bundle
Keep original records intact. Use a numbered index, a dated chronology and an allegation-to-evidence matrix. Mark missing records and explain gaps rather than recreating or backdating documents. Separate historic non-compliance from actions already completed and measures still planned.
Check the call-up letter for any required format, disclosure date, witness attendance or submission instructions. Requirements vary with the case.
