Appeal Deadline Approaching: What to Organise First
A triage approach to the decision notice, deadline, reasons, evidence and procedural documents when time is short.
Updated 3 October 2026
When an appeal deadline is approaching, the first task is triage: identify the decision, the date and method of service, the applicable route and the documents needed to protect the next step. Merits work should not obscure a time limit.
1. Identify the decision being appealed
Keep the complete decision notice, attachments and reasons. Record who made the decision, the date shown on it and the date it was actually received or served.
2. Verify the route and deadline
Use the decision notice and the applicable procedure to identify the correct review, tribunal or court route. Do not assume that an internal complaint or correspondence pauses another deadline.
3. Separate essential filing material from later evidence
Identify what must be lodged or served to start the process and what can be developed later under the applicable rules. Keep a separate deadline sheet for directions, evidence and hearing dates.
4. Create a rapid issue map
List the reasons for the decision, the points disputed, the strongest documents already available and any evidence that still needs to be obtained.
5. Escalate specialist issues early
If the route involves reserved litigation work, complex jurisdiction, limitation or an urgent interim application, obtain appropriately authorised advice promptly while keeping the evidence file organised.
Appeal and hearing deadlines may be strict. Preparation does not extend any deadline or replace checking the applicable procedure.
Questions to ask before proceeding
What is the exact decision? What deadline applies? Which facts are genuinely disputed? What documents prove the important facts? What framework governs the decision? What outcome are you asking for? What has already been tried?
