What is being investigated?
Director disqualification concerns conduct, not simply whether a company failed. The Insolvency Service may examine matters including accounting records, tax liabilities, creditor treatment and decisions made while a company was in financial difficulty. The specific allegation and statutory route matter; no adverse finding should be assumed from an enquiry alone.
Build a director conduct chronology
Map the director's appointment dates, responsibilities, financial information available at each stage, board decisions, professional advice, company trading position and correspondence. Distinguish contemporaneous evidence from later recollection and identify where records are missing.
Examine each allegation separately
Create an allegation matrix linking each asserted act or omission to its date, documentary source, factual explanation and contrary evidence. Assess the underlying records without claiming that delegation to an accountant or another director automatically removes responsibility.
What to supply
Send the Insolvency Service letter, allegations or draft undertaking, relevant accounts and management records, board minutes, accountant correspondence, banking records and any stated response date. Do not sign an undertaking or miss a court deadline while awaiting our review.
Preparation deliverables
An indexed chronology, issue matrix, source-document schedule, missing-record requests and factual response material. Decisions about undertakings, proceedings and legal strategy should be taken with an appropriately authorised adviser.
