Liquidator demands and repayment claims

The Liquidator Is Demanding Money From You. Does the Evidence Add Up?

A demand may concern an overdrawn director loan account, disputed dividends, company expenditure or alleged recoverable transactions. We help you establish exactly what is claimed and what the underlying records show.

Understand the basis of the demand

Identify whether the letter alleges a contractual loan debt, an unlawful distribution, a transaction challenge, misfeasance or another basis. Different claims have different factual and legal requirements; the description in the letter should not be treated as a substitute for the supporting calculation.

Reconstruct the director loan account

Request the opening balance, transaction-level ledger, journal history, bank statements and supporting invoices or payroll records. Trace debits, credits, repayments, expenses, funds introduced and any dividend documentation. Flag unexplained balances rather than assuming they are invalid.

When the liquidator was originally instructed by you

A director may have recommended or engaged an insolvency practitioner before the appointment. The liquidator's independent duties after appointment may nevertheless require investigation or recovery. We can organise the appointment correspondence alongside the later claim without alleging a conflict merely because a demand followed.

What to send us

The full demand, statement of account, supporting schedules, liquidation correspondence, available company records, details of the accounting arrangements and any statutory demand or court papers.

Our output

A transaction reconciliation, allegation schedule, chronology, unanswered-document list and structured factual response materials. Do not assume correspondence pauses statutory or court deadlines.

Liquidator demanding repayment: questions directors ask

Does a liquidator's letter prove I owe the money?

No. A demand sets out a claim; the basis and supporting records need to be examined. Equally, a disagreement with the ledger does not automatically defeat the claim.

Can I ask for a full director loan account ledger?

You can request a transaction-level breakdown and the documents relied upon. What must be supplied, and by when, depends on the circumstances and any applicable procedure.

What if the liquidator was appointed after I instructed an insolvency practitioner?

After appointment, a liquidator has duties relating to the insolvent estate. A later demand does not itself establish misconduct or a conflict of interest.

Will asking for documents stop a statutory demand deadline?

No automatic suspension should be assumed. Seek urgent authorised advice if you have received a statutory demand or court papers.

Prepare a document pack before your first response

Preserve the full demand and attachments, the company accounts, transaction ledger, bank evidence, director appointment dates, dividend and payroll records, correspondence with accountants and any insolvency appointment paperwork. Keep a separate list of missing documents.

One investigation or demand can overlap with other issues. Identify each notice and deadline separately. We can help organise the records and allegations for an initial assessment.

Independent non-reserved case preparation, not a solicitor's practice. If proceedings or formal response deadlines apply, seek appropriately authorised legal advice promptly. An enquiry does not suspend a deadline.
