Taxi Licence Appeal: Magistrates’ Court Evidence Preparation

How to organise the decision notice, council policy, chronology, disputed evidence and supporting documents for a taxi or private hire licence appeal.

Updated October 2026

A taxi or private hire licence appeal file should make the challenged decision, appeal deadline, reasons, council policy and supporting evidence immediately visible. The preparation role should remain distinct from reserved conduct of litigation unless lawfully undertaken.

1. Preserve the appeal route

Keep the complete decision notice and verify the applicable court, statutory time limit and procedural route for that particular decision. Record the date of service rather than assuming the deadline from the decision date.

2. Identify the issues actually under appeal

List each refusal, revocation, suspension or non-renewal reason separately and identify whether the challenge is factual, evidential, policy-based, procedural, mitigation-based or a combination.

3. Build the appeal evidence set

Organise the authority’s evidence, current licensing policy, licence history, police or complaint material and new or corrective evidence around each disputed reason.

4. Create a court-ready working structure

Prepare a chronology, issue schedule, key-document list and evidence index so the person conducting the appeal can locate the material quickly.

5. Keep the requested outcome explicit

State what decision is being challenged and the precise licensing outcome sought. The evidence and submissions structure should point back to that outcome throughout.

Important for this type of matter

Licensing routes and deadlines depend on the decision and statutory scheme. Court filing and advocacy can engage reserved-activity rules, so the preparation role must be kept distinct.

Questions to ask before proceeding

What is the exact decision? What deadline applies? Which facts are genuinely disputed? What documents prove the important facts? What framework governs the decision? What outcome are you asking for? What has already been tried?

Official sources to check

Rules, guidance and procedures can change. These are the primary official sources used to keep this area grounded:

Frequently asked questions

Can I appeal a taxi or private hire driver licensing decision?

GOV.UK confirms that a final refusal of a taxi or private hire driver licence can be appealed to the Magistrates’ Court. The decision notice and statutory scheme should be checked immediately for the route and deadline.

Does a revocation always take effect immediately?

No. Department for Transport guidance distinguishes immediate suspension or revocation on public-safety grounds from other decisions which generally take effect after the statutory notice period.
